1. Who we are

ConsulShivTech is run by Shivam Ojha as a sole proprietorship based in India (“we”, “us”). “You” means the person or business using this site or buying from us. You can reach us through the contact form.

2. The discovery call

1. Free. The discovery call is free: 30 minutes on video, with no card and no obligation. You send a short brief about your idea, then choose a time on our booking calendar.
2. Our cancellation. If we cancel, or we fail to join the call, we will offer a new time within 14 days.
3. Rescheduling. If you cannot make it, move or cancel the call from your booking email at least 24 hours before it starts, so the time can go to someone else. If you do not join within 15 minutes of the start time, the call is cancelled.
4. What the call is. The call is an initial conversation about your idea, stage and budget, and whether we are the right fit. It is not a plan, an estimate or professional advice you should rely on without a written engagement.
5. Consumers. Nothing in these terms limits any right you have under consumer law that cannot be excluded.

3. Discovery Sprint, retainer and builds

Work after the discovery call is set out in a written proposal or statement of work that you accept before we start. If it conflicts with these terms, the written proposal wins. Unless it says otherwise:

1. Discovery Sprint. Fixed price of $2,500, delivered over 2–3 weeks. Payment: 50% before we start and 50% on delivery of the sprint documents, due within 7 days of each invoice.
2. Strategic Partner retainer. $2,500 / month, invoiced monthly in advance. Scope: Up to 20 hours a month, plus every sprint planning and review meeting. Unused hours do not carry over. Either side can end the retainer with 30 days’ written notice; the current month is not refunded.
3. Builds. A build by our team is quoted after the sprint, from the plan, and covered by its own agreement.
4. Website package. A custom-coded 4-page website for $1,000: 50% before we start and 50% at launch, due within 7 days of each invoice. Delivery is 10 working days from when we receive your text and images, and includes 2 rounds of changes. You register and own the domain. Once the build is paid in full, you own the website’s design and source code, and we hand the full source code over to you. You can pay the 50% deposit ($500) online by card before a kickoff call, and then the deposit is refunded in full if, on the kickoff call, either of us decides not to go ahead, and it is non-refundable once work has started. A refund goes back to the card you paid with, within 7 days of the call.
5. Maintenance and management plan. $300 / month, invoiced monthly in advance, renewing each month until either side ends it with 30 days’ written notice. It covers maintenance and management of the website we built: hosting, SSL, security and browser updates, uptime monitoring, backups, keeping the domain connection and forms working, and up to 3 hours of changes a month; unused hours do not carry over. When it ends, we hand over the website files and help you move them.
6. Cancelling a sprint. You can stop a sprint at any time in writing. You pay for the work done to that point, at least the first 50%, and you receive everything produced so far.
7. Late payment. We can pause work while an invoice is more than 14 days overdue.

4. Ownership of the work

Once you have paid for it in full, you own the documents we produce for you, including user flows, scope, PRD, wireframes, budgets and shortlists. You can use them with any team. We keep our general know-how, methods and templates, and can reuse them without your confidential information. For builds by our team, code, accounts and repositories are held in your name.

5. Confidentiality

We keep what you tell us confidential and use it only to work with you. Yes, before the sprint starts. The discovery call covers the idea at whatever level of detail you are comfortable sharing. Before an NDA is signed, share only what you are comfortable sharing.

6. Teams we recommend

We take no referral fees or commissions from any team we recommend. When you hire a team from our shortlist, you contract with that team directly. We are not a party to that contract and are not responsible for its work, but on a retainer we review its estimates, invoices and progress on your behalf.

7. No guarantees

We give our honest professional view. We cannot guarantee a product’s cost, delivery date, funding, adoption or commercial success, because those depend on decisions and people outside our control. Cost comparisons and rate ranges on this site are indicative only. They are not quotes and not a promise of any saving.

8. Liability

Our total liability to you for any claim about our services is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect or consequential loss, such as lost profits, lost data or lost opportunity. Nothing here limits liability for fraud, or anything else the law does not allow us to limit.

9. Chat assistant

The chat assistant is automated and can be wrong. Nothing it says is an offer or a commitment. Confirm anything important with us through the contact form.

10. Using this site

Do not misuse the site: no attempts to break its security, overload it, or send spam through its forms. The site’s text, design and video belong to us. Prices on the site are current offers and can change; the price you pay is the one shown when you pay.

11. Governing law

These terms are governed by the laws of India. The courts of India have exclusive jurisdiction, except that consumers keep any right to bring a claim in the courts where they live.

12. Changes

We may update these terms. The version that applies to a purchase is the one shown when you paid. The date below shows the current version.
